A denúncia e o registro de fatos que envolvem o racismo são importantes formas de se combater um dos principais problemas que afetam sua prevenção: o silêncio. Pensando nisso, desde 2018, a Polícia Civil com a instituição da Delegacia Especializada de Investigação de Crimes de Racismo, Xenofobia, LGBTFobia e Intolerâncias Correlatas (Decrin), atua de forma qualificada para a repressão dos crimes contra a raça e também no oferecimento de informações que auxiliam o combate desses delitos por parte da população mineira.
Em Minas Gerais, de janeiro a setembro de 2022, foram registrados 34 crimes resultantes de preconceitos de raça ou de cor e 352 de injúria – causa presumida racismo. Os dados são do Observatório de Segurança Pública, da Secretaria de Estado de Justiça e Segurança Pública (Sejusp-MG) – que reúne dados checados no sistema de Registro de Eventos de Defesa Social (Reds).
Os números, contudo, não correspondem a valores absolutos de todos os crimes, uma vez que fatores como subnotificação ou registros em outras modalidades criminosas podem afetar a análise de contexto. Por isso é tão importante procurar a polícia para a devida responsabilização criminal, como alerta a delegada Sílvia Helena de Freitas Mafuz, titular da Decrin.
“Precisamos, cada vez mais, conscientizar as pessoas sobre a relevância de registrar crimes dessa natureza, fazer o boletim de ocorrência, enfim, de buscar por seus direitos”, enfatiza. “Porque só assim conseguiremos construir uma sociedade livre de preconceitos, que respeite o ser humano independentemente de sua raça, cor, religião ou etnia. Todos merecemos respeito”, destaca.
- Racismo x injúria racial
Identificar a diferença entre os crimes de racismo e de injúria racial é fundamental para o momento de denunciar. Conforme define a lei, o racismo ocorre quando o agressor atinge toda uma comunidade, discriminando uma etnia de forma geral. Um exemplo é quando um cidadão se recusa ou impede a entrada de pessoas em um estabelecimento comercial ou a utilização de um serviço com base na raça delas. A pena definida para o crime de racismo, prevista na Lei 7.716/89, a Lei do Crime Racial, é de dois a cinco anos de reclusão.
Já a injúria racial é percebida quando o agressor faz uso de palavras depreciativas ou de xingamentos com intenção de ofender a honra da vítima, valendo-se dos elementos que constituem sua raça, cor, etnia, religião, entre outros. A pena prevista para esse crime é de um a três anos de prisão.
