O Supremo Tribunal Federal (STF) decidiu validar a lei que criou o Estatuto Geral das Guardas Municipais. A norma entrou em vigor em 2014 sendo sancionada pela então presidente Dilma Rousseff para estabelecer normas gerais para as guardas municipais de todo o país.
A lei foi questionada no Supremo pela Associação Nacional dos Agentes de Trânsito no Brasil (AGTBrasil). Entre os pontos questionados, a associação pediu a suspensão do trecho que concedeu aos guardas a competência de fiscalização de trânsito.
A unanimidade na votação foi formada a partir do voto do relator, ministro Gilmar Mendes. Para o ministro, os guardas podem fazer a fiscalização de trânsito nos municípios.
“A Lei Federal 13.022/2014, ao dispor sobre o Estatuto das Guardas Municipais, constitui norma geral, de competência da União, sendo legítimo o exercício, pelas guardas municipais, do poder de polícia de trânsito, se assim prever a legislação municipal’, escreveu o ministro.
O julgamento ocorreu no plenário virtual, modalidade na qual os ministros inserem os votos no sistema e não há deliberação presencial. O julgamento foi finalizado no dia 30 de junho, e divulgado nesta terça (11). (COM AGÊNCIA BRASIL)
