Todas as mulheres agora têm direito a um acompanhante maior de idade, sem que haja necessidade de aviso prévio, durante as consultas médicas, exames e procedimentos realizados em unidades públicas e privadas de saúde. O direito foi ampliado pela lei 14.737/2023, publicada nesta terça-feira (28), no Diário Oficial da União.
A nova legislação altera a Lei Orgânica da Saúde (8.080/1990) e determina ainda que – em casos de procedimento com sedação que a mulher não aponte um acompanhante – a unidade de saúde será responsável por indicar uma pessoa para estar presente durante o atendimento. A renúncia do direito deverá ainda ser assinada pela paciente, com um mínimo de 24 horas de antecedência.

As mulheres também devem ser informadas sobre esse direito tanto nas consultas que antecedam procedimentos com sedação, quanto por meio de avisos fixados nas dependências dos estabelecimentos de saúde.
Para centros cirúrgicos e unidade de terapia intensiva em que haja restrição por motivos de segurança à saúde dos pacientes, o acompanhante deverá ser um profissional de saúde.
O direito de acompanhamento da mulher só poderá ser sobreposto nos casos de urgência e emergência, pela defesa da saúde e da vida. Isso só poderá acontecer quando a paciente chegar desacompanhada à unidade de atendimento.
