O Congresso Nacional derrubou os vetos do presidente Luiz Inácio Lula da Silva à lei que restringe a saída temporária de presos, conhecida como saidinha. O tema foi analisado na tarde desta terça-feira (28), em sessão conjunta da Câmara e do Senado.
Na lei aprovada pelos parlamentares, a concessão do benefício era proibida para condenados por crimes hediondos e violentos, como estupro, homicídio e tráfico de drogas. Mas Lula havia vetado o trecho, na mesma lei, que impedia a saída de presos do regime semiaberto, condenados por crimes não violentos, para visitar as famílias. Até então, presos que estavam no semiaberto, que já tinham cumprido um sexto do total da pena e com bom comportamento, poderiam deixar o presídio por cinco dias para visitar a família em feriados, estudar fora ou participar de atividades de ressocialização.
Com a rejeição do veto pelos parlamentares, os detentos ficam impedidos de deixar as prisões em feriados e datas comemorativas, como Natal e Dia das Mães, mesmo para aqueles do semiaberto.
A saída para estudos e trabalho continua permitida. Os critérios a serem observados para concessão são: comportamento adequado na prisão; cumprimento mínimo de 1/6 da pena, se o condenado for primário, e 1/4, se reincidente; e compatibilidade do benefício com os objetivos da pena.
