A Agência Nacional de Telecomunicações (Anatel) determinou nesta segunda-feira (23) um conjunto de medidas às prestadoras de serviços de telecomunicações com o objetivo de impedir o uso de ligações telefônicas para aplicação de golpes e fraudes.
A agência reguladora esclarece que as medidas determinadas pretendem garantir a transparência e a rastreabilidade das ligações telefônicas e correspondem a uma resposta à atualização de métodos usados por fraudadores e ações complementares a outras disposições já implementadas pela Anatel e em andamento.
Medidas
A realização de novas etapas de verificação das chamadas está entre as providências que devem ser tomadas pelas empresas. As operadoras também deverão proibir o uso de múltiplos números aleatórios para chamadas realizadas a partir de uma mesma origem. A prática tem dificultado a identificação de quem está ligando e, consequentemente, prejudica o bloqueio de chamadas indesejadas ou fraudulentas, no telefone do consumidor, se este desejar. De acordo com a Anatel, esta prática é adotada pelo mercado de telesserviços.
A Anatel definiu ainda a criação de um canal para centralizar o recebimento de denúncias de instituições financeiras sobre números utilizados para o cometimento de golpes e fraudes. A partir dessas notificações, cada operadora deverá usar as informações para identificar o usuário e a prestadora de origem das chamadas, bloquear o acesso do usuário às redes de telefonia e acionar as autoridades de segurança pública.
O descumprimento das medidas estabelecidas pela Anatel poderá resultar na aplicação de multas de até R$ 50 milhões ou até mesmo na extinção da autorização para prestação de serviço de telecomunicações da operadora que for considerada conivente com as práticas criminosas.
Bloqueio de ligações
Especificamente sobre ligações de telemarketing ativo, as principais prestadoras de serviços de telecomunicações criaram a plataforma Não Me Perturbe. Com a autorização da Anatel, desde 2022, o sistema possibilita que os consumidores que não desejam receber este tipo de ligação telefônica se cadastrem gratuitamente na Lista Nacional de Não Perturbe.
Em até 30 dias após o pedido de cadastramento, o consumidor não receberá mais ligações para a oferta de serviços de telefonia fixa, telefonia móvel, banda larga e TV por assinatura das prestadoras e serviços de telecomunicações participantes. Os bloqueios também podem ser para promoção de vendas e serviços por meio de contato telefônico de empréstimo consignado e cartão de crédito consignado, por parte de instituições financeiras participantes.
No caso de instituições financeiras, o bloqueio de ligações não se aplica à realização de cobrança de débitos, oferta de refinanciamento de dívidas, solicitação de portabilidade de serviços, confirmação de dados, prevenção a fraudes.
Além do site, o Não Me Perturbe está disponível em aplicativo para smartphones, que pode ser baixado gratuitamente em lojas virtuais. O usuário pode efetuar o bloqueio diretamente no próprio celular para não receber ligações de telemarketing de empresas. (COM AGÊNCIA BRASIL)
