    PROJETO DE LEI VISA AUMENTAR EM 20 ANOS PRAZOS DE PRESCRIÇÃO DE PENA

    O Projeto de Lei 827/21 aumenta em 20 anos todos os prazos prescricionais previstos no Código Penal. A proposta, da deputada Alê Silva (PSL-MG), tramita na Câmara dos Deputados. O objetivo da parlamentar é combater a impunidade no Brasil.

    A prescrição é a perda do direito de punir do Estado, pelo decurso do tempo e se regula pelo máximo da pena privativa de liberdade relacionada ao crime cometido.

    Atualmente, um crime pode prescrever em três anos, se o máximo da pena for menor que um ano, ou em 20 anos, se o máximo da pena for superior a 12 anos, por exemplo. Pela proposta de Alê Silva, esses prazos passariam, respectivamente, para 23 e para 40 anos.

    Uma das motivações da deputada para apresentar o projeto foi a recente decisão do ministro do Supremo Tribunal Federal (STF) Edson Fachin de anular as condenações do ex-presidente Luiz Inácio Lula da Silva, com a justificativa que a 13ª Vara da Justiça Federal em Curitiba não tinha competência para julgar os casos.

    “Há uma grande probabilidade de esta ação resultar na prescrição dos crimes que serão julgados. Se isso ocorrer, será um escárnio, um ‘tapa na cara’ de toda a sociedade brasileira que acompanhou perplexa a apuração e os desdobramentos da Operação Lava Jato”, avalia Alê Silva.

    Ela lembra que a proposta, caso seja aprovada e vire lei, não valerá para esse caso, mas para os futuros. Na opinião da deputada, as regras vigentes são “excessivamente brandas” e “têm trazido um enorme sentimento de impunidade e de injustiça para a população brasileira”.

    Além de aumentar os prazos prescricionais, o projeto cria uma nova causa interruptiva da prescrição. Pelo texto, o curso da prescrição poderá ser interrompido nos casos de decisão judicial que declare a incompetência absoluta de um juízo criminal, caso da decisão de Fachin relacionada a Lula.

    “Não se pode punir toda a sociedade e premiar criminosos com a impunibilidade por um erro na tramitação do processo criminal, muitas vezes causado pelas confusas regras de determinação de competência judicial. Se o Estado não permaneceu inerte, se o Estado se movimentou no sentido da punição de criminosos, não faz sentido que o criminoso seja beneficiado por regras brandas de prescrição e seja colocado em liberdade, como se nada tivesse feito ou nenhum crime praticado”, defende a autora do projeto.
