    USO DE TORNOZELEIRAS ELETRÔNICAS AUMENTA 296% EM MINAS

    O uso de tornozeleiras eletrônicas como forma de medida cautelar alternativa à prisão aumentou 296% em cerca de dois anos e meio no Estado, de outubro de 2018 até o momento. O número foi apresentado, nesta quarta-feira (26), pelo superintendente de Gestão de Vagas da Secretaria de Estado de Justiça e Segurança Pública (Sejusp), Leonardo Badaró. Ele participou de audiência pública da Comissão de Segurança Pública da Assembleia Legislativa de Minas Gerais (ALMG).

    De acordo com o superintendente, apenas na pandemia, de março de 2020 a abril deste ano, o aumento foi de 48%. Ele contou que atualmente 5.802 pessoas usam tornozeleiras eletrônicas no Estado. Já a população carcerária é de 59 mil indivíduos em Minas. Ainda segundo o superintendente, recentemente foi feito um aditivo ao contrato do governo estadual para o uso das tornozeleiras eletrônicas, que poderá ser ampliado de cerca de 5 mil para até 6.250 presos.

    Leonardo Badaró relatou que o custo de um monitorado por mês é de R$ 280, enquanto que o de um preso no regime fechado fica em torno de R$ 4 mil mensalmente. Ele defendeu a integração dos diversos setores e instituições para combater a criminalidade e salientou que um grupo de trabalho analisa possíveis soluções para os gargalos existentes.

    O superintendente de Investigação e Polícia Judiciária da Polícia Civil, Márcio Simões Nabak, contou que, de 1º de janeiro de 2019 a 24 de maio deste ano, foram identificadas 9.316 ocorrências policiais com a expressão tornozeleira eletrônica no histórico do Sistema Integrado de Defesa Social (Reds). Desse total, conforme contou, 3.722 têm natureza criminal.

    Segundo Márcio Simões, 77,5% das ocorrências com natureza criminal foram despachadas, 57,37% foram utilizadas para instauração de procedimentos criminais e 25,20% ensejaram a elaboração do procedimento de auto de prisão em flagrante delito. O superintendente enfatizou ainda que, em 2019, foram 2.513 ocorrências registradas de crimes cometidos por tornozelados, em 2020, foram 4.613, e de janeiro até 24 de maio deste ano, já são 2.190 casos. “Acreditamos que esses números vão aumentar porque várias pessoas saíram do regime fechado e passaram a usar tornozeleiras por causa da pandemia e essas pessoas têm reincidido no crime”, afirmou.

    Márcio Simões também destacou a necessidade de o Reds ser modificado para ter um campo em que se possa inserir que o crime foi praticado por alguém que usa tornozeleira eletrônica. Ele explicou que atualmente essa informação consta apenas no histórico do sistema, o que dificulta a pesquisa.

    O comandante do policiamento da Capital, coronel da Polícia Militar Webster Wadim, relatou a alta reincidência dos monitorados com tornozeleira eletrônica em crimes, muitas vezes graves como homicídio, tráfico e estupro.

    Ele citou casos de pessoas com histórico de reincidir 50 ou 60 vezes em práticas criminosas. “O Poder Judiciário precisa enxergar essa reincidência. Muitas vezes, nosso trabalho é tentar enxugar gelo”, reforçou. Na opinião dele, o uso da tornozeleira eletrônica deve servir para que o indivíduo tenha uma oportunidade de se adequar à vida em sociedade. “Se isso não acontece, ele deveria voltar ao regime fechado até que se conscientize”, afirmou.

    Webster Wadim também disse que o monitoramento dos tornozelados precisa passar por algumas adequações. Ele contou que informações dos monitorados nem sempre chegam com antecedência. Ele também frisou a falta de um campo específico no Reds para inserir que quem praticou o crime usa tornozeleira. “Hoje o monitoramento ainda falha na prevenção. Mas ganhamos muito em monitorar no pós-crime”, afirmou.

    O comandante ainda salientou a relevância da Lei 23.753, de 2021, que teve origem em projeto de autoria do deputado Sargento Rodrigues (PTB), que preside a comissão e solicitou a audiência desta quarta (26).

    A legislação garante, entre outros aspectos, a utilização de forma integrada dos sistemas de informação relativos à segurança pública, pertencentes a órgãos e entidades da administração pública estadual, pela Polícia Militar e pela Polícia Civil. Dessa forma, permite, por exemplo, acesso ao sistema de monitoramento de tornozeleiras eletrônicas no Estado. Desde o ano passado, a Sejusp havia cancelado as senhas de acesso das Polícias Militar e Civil a esse sistema.
