A Lei 23.856, que estabelece comunicação obrigatória de maus-tratos a animais à Polícia Civil, foi sancionada pelo governador Romeu Zema no sábado (31/7/21), no Diário Oficial do Estado.
A nova norma, aprovada em 12 de julho pelo Plenário da Assembleia Legislativa de Minas Gerais (ALMG), teve origem no Projeto de Lei (PL) 177/19, de autoria do deputado Dalmo Ribeiro Silva (PSDB).
O texto acrescenta à Lei 22.231, de 2016, que já busca combater os maus-tratos a animais, a obrigação dos estabelecimentos veterinários comunicarem indícios desse tipo de ocorrência.
Segundo a lei, a notificação à Polícia Civil deverá conter o nome e endereço do acompanhante do animal no momento do atendimento; e relatório do atendimento prestado, incluindo a espécie, raça e características físicas do animal, a descrição de sua situação de saúde na hora do atendimento e os procedimentos adotados.
Também prevê que o descumprimento por parte dos estabelecimentos veterinários sujeitará o infrator às sanções previstas na mesma lei.
– Animais de rua
Outra norma sancionada no sábado, a Lei 23.863, trata da proteção animal. Ela tem origem do PL 1.243/19, do deputado Osvaldo Lopes (PSD), aprovado em Plenário em 12 de julho, que dispõe sobre a garantia de disponibilização de alimento e água para os animais de rua pelos cidadãos, em espaços públicos, no Estado.
A nova lei acrescenta dispositivos à Lei 21.970, de 2016, que dispõe sobre a proteção, a identificação e o controle populacional de cães e gatos.
O texto sancionado assegura a qualquer cidadão o direito de fornecer, nos espaços públicos, na forma e nas quantidades adequadas ao bem-estar, alimento e água aos animais em situação de rua, inclusive aos cães e gatos comunitários.
A norma também prevê que o ato de impedir alguém de disponibilizar a água e a comida será configurado como “maus-tratos aos animais” e, assim, estará sujeito a penas previstas em lei.
