CONDENAÇÕES DE LULA RELACIONADAS À LAVA JATO SÃO ANULADAS E ELE VOLTA A SER ELEGÍVEL

O ministro Edson Fachin, do Supremo Tribunal Federal (STF), anulou hoje (8) todas as condenações do ex-presidente Luiz Inácio Lula da Silva pela Justiça Federal no Paraná relacionadas às investigações da Operação Lava Jato. Com a decisão, Lula recupera os direitos políticos e volta a ser elegível.
Ao decidir sobre pedido de habeas corpus da defesa de Lula impetrado em novembro do ano passado, Fachin declarou a incompetência da Justiça Federal do Paraná nos casos do triplex do Guarujá, do sítio de Atibaia e das doações ao Instituto Lula. Segundo o ministro, a 13ª Vara Federal de Curitiba, cujo titular na ocasião das condenações era o ex-juiz federal Sergio Moro, não era o “juiz natural” dos casos.
A decisão tem caráter processual. O ministro não analisou o mérito das condenações. Agora, os processos serão analisados pela Justiça Federal do Distrito Federal, à qual caberá dizer se os atos realizados nos três processos podem ou não ser validados e reaproveitados.
“Inicialmente, retirou-se todos os casos que não se relacionavam com os desvios praticados contra a Petrobras. Em seguida, passou a distribuir por todo território nacional as investigações que tiveram início com as delações premiadas da Odebrecht, OAS e J&F. Finalmente, mais recentemente, os casos envolvendo a Transpetro (subsidiária da própria Petrobras) também foram retirados da competência da 13ª Vara Federal de Curitiba”, diz a nota do gabinete do ministro.
De acordo com o texto, nas ações penais envolvendo Lula, assim como em outros processos julgados pelo plenário e pela Segunda Turma do STF, “verificou-se que os supostos atos ilícitos não envolviam diretamente apenas a Petrobras, mas, ainda outros órgãos da Administração Pública”.
Segundo o ministro, em outros casos de agentes políticos denunciados pelo Ministério Público Federal em circunstâncias semelhantes ao de Lula, a Segunda Turma do Supremo já vem transferindo esses processos para a Justiça Federal do Distrito Federal.
Embora divergente e derrotado nas votações na Segunda Turma em relação a esse ponto, Fachin considerou que o mesmo entendimento deveria ser aplicado ao ex-presidente.
