Proprietários que tiverem seus veículos, registrados em Minas Gerais, roubados ou furtados serão informados sobre o direito à restituição do valor pago do Imposto sobre a Propriedade de Veículos Automotores (IPVA). A ampliação da divulgação está prevista na Lei 23.858/2021, sancionada pelo governador Romeu Zema e publicada no Diário Oficial no sábado (31). A norma entrará em vigor em 90 dias e depende de regulamentação por meio de decreto.
Ao registrar o Boletim de Ocorrência relatando o furto ou roubo em uma delegacia da Polícia Civil, a informação é inserida na base de dados do Departamento de Trânsito de Minas Gerais (Detran-MG) e da Secretaria de Estado de Fazenda (SEF). Porém, a restituição do IPVA pago não é automática. O proprietário deve fazer o requerimento junto à SEF, anexando documentos necessários para a comprovação tanto do roubo ou furto quanto do pagamento do imposto.
Todas as informações sobre a restituição já são disponibilizadas no site da Secretaria de Fazenda, mas a nova lei prevê que o contribuinte deverá ser diretamente informado sobre esse direito, entre outras formas, por meio de mensagem de celular (SMS). A informação também deverá ser exibida na guia de pagamento do IPVA e nos sites do Detran e da SEF. Sobre a guia de pagamento, a Secretaria de Fazenda alerta que nenhum boleto é enviado para o endereço do contribuinte, mas o documento pode ser emitido no site da instituição.
– Como pedir a restituição
Tem direito a pedir a restituição do IPVA todo proprietário que teve seu veículo roubado ou furtado. Para isso, ele tem que comprovar o crime por meio de ocorrência registrada na Polícia Civil com o gravame do impedimento por furto ou roubo no cadastro do veículo e ter quitado o imposto. De posse desses documentos comprovantes, deve entrar no site www.fazenda.mg.gov.br, na área “Cidadãos”, e clicar em “IPVA”, depois “Restituição”. Basta o proprietário preencher o formulário com seus dados pessoais e do veículo e anexar, escaneados, os documentos solicitados.
Tudo é feito pela internet, sem necessidade de comparecer à repartição fazendária. Em caso de dúvida, o cidadão pode acionar o Fale Conosco, no próprio site da SEF. O melhor momento para pedir a restituição é quando o veículo for encontrado ou após virar o exercício, no caso de o patrimônio não ser recuperado.
A restituição é proporcional ao período, em dias, desde a data do roubo até a devolução do veículo, caso este seja encontrado no mesmo ano. Caso o veículo não seja recuperado, o cálculo é feito desde a data do roubo até 31 de dezembro do ano em exercício. Permanecendo o veículo desaparecido, o proprietário fica isento do IPVA do ano seguinte.
O valor ao qual o contribuinte tem direito é depositado automaticamente na conta corrente indicada por ele na solicitação. A solicitação pode ser feita a qualquer momento, a partir do roubo ou furto do veículo, dentro do prazo de até cinco anos.
