ELEIÇÕES 2022: DIPLOMAÇÃO DOS ELEITOS DEVE OCORRER ATÉ 19 DE DEZEMBRO

A diplomação dos eleitos no primeiro e no segundo turnos nas Eleições Gerais de 2022 deve ocorrer até o dia 19 de dezembro. Cabe ao Tribunal Superior Eleitoral (TSE) entregar os diplomas do presidente e do vice-presidente da República eleitos no domingo (30). A data da cerimônia de diplomação no TSE ainda será definida.
Já aqueles que se elegeram para os cargos de governador, senador, deputado federal e estadual ou distrital serão diplomados pelos Tribunais Regionais Eleitorais (TREs) dos 26 estados e do Distrito Federal. As cerimônias de entrega dos diplomas a esses eleitos serão marcadas pelos próprios TREs, respeitando a data-limite de 19 de dezembro.
A diplomação é uma cerimônia organizada pela Justiça Eleitoral e serve para formalizar que o diplomado foi escolhido pela maioria dos eleitores. Ela marca o encerramento do processo eleitoral. Nessa ocasião, são entregues os diplomas, assinados pelo presidente do TSE e dos respectivos TREs ou junta eleitoral.
O diploma expedido pela Justiça Eleitoral atesta a vitória nas urnas, tornando os eleitos aptos a tomar posse. Sem esse documento, eles não podem assumir o cargo. Não será diplomado o candidato que estiver com o registro indeferido, ainda que o recurso esteja pendente de julgamento.
Vale lembrar que, enquanto o Tribunal Superior Eleitoral não decidir sobre eventual recurso contra a expedição do diploma, o diplomado poderá exercer o mandato em toda a plenitude. Esse recurso está previsto no artigo 262 do Código Eleitoral e deve ser interposto no prazo de três dias contados da diplomação.
