As eleitoras e os eleitores obrigados a votar que não compareceram às urnas no segundo turno das Eleições 2022 e nem justificaram a ausência no dia do pleito têm até 9 de janeiro de 2023 para apresentar a justificativa, segundo o artigo 7º da Lei nº 6.091/1974. A pessoa que tem título eleitoral no país e não votou por estar no exterior também tem igual prazo para se justificar, ou 30 dias contados da data do retorno ao Brasil.
Quem não votou no primeiro turno das eleições, em 2 de outubro, e não justificou a ausência no dia da votação tem até 1º de dezembro para apresentar a justificativa. Vale lembrar que a Justiça Eleitoral considera cada turno uma eleição separada.
A justificativa deve ser feita, preferencialmente, pelo aplicativo e-Título, da Justiça Eleitoral. O aplicativo pode ser baixado gratuitamente nas plataformas Google Play (Android) e App Store (iOS).
Também poderá ser enviada pelo Sistema Justifica ou por meio do Requerimento de Justificativa Eleitoral (RJE) – pós-eleição à zona eleitoral competente. O eleitor faltoso precisará apresentar a documentação que comprove o motivo pelo qual ficou impossibilitado de comparecer ao pleito. Caberá à autoridade judiciária da zona eleitoral responsável pelo título analisar a justificativa apresentada.
O Sistema Justifica é uma ferramenta que possibilita a apresentação do RJE pós-eleição pela internet. No sistema, a eleitora ou o eleitor deverá informar os dados pessoais (exatamente como registrados no cadastro eleitoral), o motivo da ausência às urnas e anexar a documentação comprobatória digitalizada.
Desde que corretamente preenchido o requerimento, será gerado um código de protocolo para acompanhamento, e o RJE será transmitido à zona eleitoral responsável pelo título para análise. A pessoa será informada da decisão. Acolhida a justificativa, ocorrerá o registro no histórico do título. Se surgir mensagem de erro na tela do sistema, a pessoa deve entrar em contato com a zona eleitoral competente para ser orientada.
Quem não justificar a ausência nas Eleições 2022 pagará multa referente a cada turno, se for o caso, no mínimo de 3% e no máximo de 10% do valor utilizado como base de cálculo (R$ 35,13), podendo ser decuplicado em razão da situação econômica do eleitor ou da eleitora, conforme a Resolução TSE nº 23.659/2021.
Os eleitores faltosos que não justificarem dentro do prazo ficam impossibilitados de: emitir documentos como carteira de identidade e passaporte; receber salário ou proventos de função em emprego público; prestar concurso público; e renovar matrícula em estabelecimento de ensino oficial ou fiscalizado pelo governo, entre outras consequências.
