Cerca de 1,8 milhão de microempreendedores individuais (MEI) precisam ficar atentos. Caso não quitem os tributos e as obrigações em atraso até terça-feira (31), eles serão incluídos na Dívida Ativa da União e estarão sujeitos a cobrança judicial.
Segundo a Receita Federal, existem 4,3 milhões de microempreendedores inadimplentes, que devem R$ 5,5 bilhões ao governo. Isso equivale a quase um terço dos 12,4 milhões de MEI registrados no país. Porém, a inscrição na dívida ativa só vale para dívidas não quitadas superiores a R$ 1 mil, somando principal, multa, juros e demais encargos. Atualmente, o 1,8 milhão de MEI nessa situação devem R$ 4,5 bilhões.
Com um regime simplificado de tributação, os MEI recolhem apenas a contribuição para a Previdência Social e pagam, dependendo do ramo de atuação, o Imposto sobre a Circulação de Mercadorias e Serviços (ICMS) ou o Imposto sobre Serviços (ISS). O ICMS é recolhido aos estados; e o ISS, às prefeituras.
Para quitar as dívidas, o microempreendedor pode emitir um Documento de Arrecadação do Simples Nacional (DAS), no portal do Simples Nacional (www8.receita.fazenda.gov.br/simplesnacional/). O débito pode ser parcelado. O DAS também pode ser emitido pelo Aplicativo MEI disponível para celulares Android ou iOS.
– Punições
Quem passar para a dívida ativa pode ter prejuízos significativos. O microempreendedor pode ter o Cadastro Nacional de Pessoa Jurídica (CNPJ) cancelado, deixando de ter direito a benefícios do INSS como o auxílio-doença e aposentadoria. O devedor também é excluído do regime de tributação do Simples Nacional, com alíquotas mais baixas de imposto e pode enfrentar dificuldades para conseguir financiamentos e empréstimos.
A inclusão no cadastro de dívida ativa também aumenta o valor do débito. Quem tem pendência com o Instituto Nacional do Seguro Socia (INSS) será cobrado na Justiça e terá de pagar pelo menos 20% a mais sobre o valor do débito para cobrir os gastos da União com o processo.
Em relação ao ISS e ao ICMS, caberá aos governos locais incluir o CNPJ do devedor na dívida ativa estadual ou municipal. O MEI terá de pagar multas adicionais sobre o valor devido.
