    MG: OPERAÇÃO COMBATE SONEGAÇÃO DE EMPRESAS QUE COMERCIALIZAM ÁLCOOL GEL

    A Receita Estadual faz buscas e apreensões, na manhã desta quarta-feira (3), em duas empresas localizadas em Betim e Nova Lima, na Região Metropolitana de Belo Horizonte. Os empreendimentos são suspeitos de praticar sonegação fiscal na comercialização de produtos de limpeza e, em especial, álcool em gel.
    As investigações da operação “Limpeza Pesada” tiveram início a partir de denúncias de concorrência desleal efetuadas por outras empresas do segmento. Levantamentos iniciais apontam prejuízo de R$ 17 milhões aos cofres públicos do Estado de Minas Gerais, somente nos últimos quatro anos.
    As apurações indicam que, para burlar o fisco, as empresas, que também são fabricantes, subfaturavam as mercadorias em operações de compra e venda realizadas entre si, emitindo documentos fiscais com valores bem menores em relação aos reais. Dessa forma, a maior parte do ICMS incidente nas operações não era recolhido.
    Outra técnica de sonegação fiscal utilizada pelas empresas investigadas é a venda de mercadorias sem emissão de notas, situação em que não há qualquer recolhimento de imposto.
    – Laranjas
    As investigações também mostram que as empresas se utilizam da figura do “sócio oculto”, na qual o verdadeiro proprietário não consta nos quadros societários. Esses são preenchidos com “laranjas”. Com isso, as empresas dificultam a cobrança, pelo Estado, dos débitos tributários.
    “Chama atenção da Receita Estadual o fato de as investigadas atuarem no segmento de materiais de limpeza, tendo como carro-chefe o álcool em gel. Temos indícios de que elas se aproveitaram da pandemia da covid-19 para multiplicar os seus faturamentos em 2020, graças a vultosas sonegações tributárias, prejudicando os seus concorrentes, que não conseguem combater os baixos preços praticados às custas do ICMS não recolhido”, ressalta o delegado fiscal Gilmar Barbosa, um dos coordenadores da operação.
    De acordo com Gilmar Barbosa, a partir de documentos e arquivos digitais apreendidos, a Receita Estadual poderá chegar a valores ainda maiores devidos pelas empresas em créditos tributários e irá cobrar dos infratores o imposto e as multas devidos. Além disso, pode ser enviada ao Ministério Público uma representação para denúncia criminal por sonegação fiscal.
    A operação “Limpeza Pesada” tem a participação de 20 servidores da Receita Estadual e quatro policiais civis.
