A partir deste mês, empreendedores mineiros poderão se beneficiar das iniciativas do Decreto de Liberdade Econômica. A implementação da norma é um dos resultados do programa Minas Livre Para Crescer, coordenado pela Secretaria de Estado de Desenvolvimento Econômico (Sede). O projeto estratégico do Governo de Minas fomenta o desenvolvimento, reduzindo a burocracia e os entraves para a criação e o desenvolvimento dos empreendimentos. Por aprovação tácita, o decreto estabelece normas de proteção à livre iniciativa e ao livre exercício de atividade econômica, além de dispor sobre a atuação do Estado como agente normativo e regulador.
Desde o dia 1 de janeiro, os órgãos estaduais do Governo de Minas devem, na liberação de qualquer atividade econômica, estabelecer um prazo de até 120 dias para análise do pleito. Caso a resposta não seja enviada ao solicitante dentro desse período, o pedido será aprovado tacitamente. Outra medida do decreto é a simplificação. Com isso, os documentos digitais passam a se equiparar aos documentos físicos para comprovação de direitos relacionados ao exercício de atividade econômica.
– Alterações
A principal mudança que o decreto trouxe para os empreendedores foi a dispensa de alvarás para atividades de baixo risco. Ao todo, 642 atividades econômicas se enquadram neste quesito. Foram revogados, também, cerca de 180 normativos legais obsoletos.
O subsecretário de Desenvolvimento Regional, Douglas Cabido, ressalta que o Governo de Minas está totalmente comprometido com a simplificação para o empreendedor. “Estamos tornando nosso estado um lugar livre para crescer, onde empresários podem aplicar seus negócios sem burocracia”, afirmou.
As atividades serão classificadas por três níveis de risco, sendo eles:
Nível de risco I: para os casos de risco leve, irrelevante ou inexistente. Este caso dispensa a solicitação de qualquer ato público de liberação.
Nível de risco II: os casos de risco moderado permitem vistoria posterior ao início da atividade, garantido seu exercício contínuo e regular, desde que não haja previsão legal em contrário e não sejam constatadas irregularidades.
Nível de risco III: casos de risco alto, que exigem vistoria prévia para início da atividade econômica.
